Welcome to Sigma Poster ("we," "our," or "us"), a SaaS platform developed and operated by Mexcoders. By creating an account or using our services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.

1. Description of Service

Sigma Poster provides a software-as-a-service (SaaS) platform that allows users to automate the creation and publishing of content to social media platforms (specifically Facebook Pages) using third-party Generative AI tools.

2. Account Registration

To access the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security of your password and API keys.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.

3. Use of Artificial Intelligence (AI)

Our Service integrates with third-party Artificial Intelligence models, including but not limited to OpenAI (Sora) and Google Vertex AI (Veo 3, Gemini 3 Pro). By using these features, you acknowledge and agree that:

  • Accuracy: AI-generated content may be inaccurate, offensive, or misleading. You are solely responsible for reviewing and editing all content before publishing it to your social media pages.
  • Ownership: Subject to the terms of the underlying AI providers, you own the rights to the content you generate, but you grant us a license to process and host it for the purpose of providing the Service.
  • No Liability: Mexcoders is not liable for any claims, damages, or penalties arising from the content generated by AI or posted by you.

4. Platform Compliance (Meta/Facebook)

Sigma Poster automates actions on the Meta (Facebook) platform. You agree to strictly adhere to the Meta Platform Terms and Community Standards.

  • No Spam: You will not use our Service to post spam, harass users, or violate Facebook's policies.
  • Account Restrictions: We are not responsible if your Facebook Page or Ad Account is restricted, banned, or suspended by Meta due to the content you post or the frequency of your posting.
  • Data Access: You grant us permission to access your Facebook Page public data and publish content on your behalf via the Facebook Graph API.

5. Acceptable Use

You agree not to use the Service to:

  • Generate or publish content that is illegal, harmful, threatening, abusive, defamatory, or obscene.
  • Infringe upon the intellectual property rights of others.
  • Reverse engineer, decompile, or attempt to extract the source code of the software.
  • Resell or sublicense the Service without our express written consent.

6. Intellectual Property

  • Our IP: The Sigma Poster platform, including its code, design, and branding, is the intellectual property of Mexcoders.
  • Your IP: You retain ownership of the text prompts you input and the specific media assets you generate, subject to the terms of the AI model providers.

7. Subscription and Billing

  • Fees: Some features of the Service are billed on a subscription or usage basis (e.g., AI generation credits). You agree to pay all fees associated with your chosen plan.
  • Refunds: Refunds are handled on a case-by-case basis and are generally not provided for used AI generation credits.

8. Limitation of Liability

To the maximum extent permitted by law, Mexcoders shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of:

  • Your use or inability to use the Service.
  • Any conduct or content of any third party on the Service.
  • Any content generated by AI and published to your social media accounts.

9. Termination

We reserve the right to suspend or terminate your account immediately, without prior notice, if you violate these Terms, specifically if you use the Service to generate illegal content or violate Meta's Platform Terms.

10. Governing Law

These Terms shall be governed by and defined following the laws of the United Mexican States (Mexico). Any dispute arising in relation to these terms shall be subject to the jurisdiction of the courts located in Mérida, Yucatán.
